How to Complete the I-9 and Prepare for an I-9 Audit
Effective March 16, 2026, U.S. Immigration and Customs Enforcement (ICE) revised the Form I-9 Inspection Fact Sheet, reclassifying a number of common errors and making them subject to immediate penalties. In the past, these types of errors (forgetting to list an employee’s date of birth, failure to sign the form, incorrect use of the Spanish form, incomplete document data, etc.) were considered technical or procedural violations and employers had 10 business days to correct them after receiving a Notice of Inspection. The revised Fact Sheet considers them substantive, and therefore subject to immediate civil penalties.
In order to minimize their risk, employers are advised to conduct I-9 self audits and correct any deficiencies they find.
